Welcome to the Verisys Weekly Newsletter highlighting the COVID-19 regulatory updates between Aug 26 - Sep 1, 2020.  

Verisys' Compliance Team gathers information from a variety of state and federal sources and updates our COVID-19 Resource Page daily with those updates. We have compiled the most recent updates from the past week in this email to assist your organization in serving patients during the pandemic and maintaining compliance as you bring additional providers on board to serve on the frontlines.

FEDERAL  
 
1135 waivers: The following state(s) submitted an additional 1135 waiver request to CMS. The approved waivers have been published by the Centers for Medicare and Medicaid Services. Unless otherwise stated, all waivers are retroactively effective March 1, 2020.  
 
Maryland (approved 08/31/2020)  
• To permit the state and clinic to temporarily designate a clinic practitioner’s location as part of the clinic facility so that clinic services may be provided via telehealth when neither the patient nor practitioner is physically onsite at the clinic.  
 
North Carolina (approved 08/28/2020)  
• Extend pre-existing authorizations for which a beneficiary has previously received prior authorization through the end of the public health emergency.  
• The initial determination of level of care does not need to be completed before the start of services.  
• Temporarily authorize reimbursement for home and community-based services provided by an entity that also provides case management services and/or is responsible for the development of the person-centered service plan in circumstances beyond the limited authority provided under regulations.  
• The face-to-face encounter does not need to be completed before the start of services.  
 
South Dakota (approved 08/31/2020)

STATE BOARD REGULATIONS
 
Board of Pharmacy  
 
California  
08/25/2020:  
• Use of PPE in certain compounding aseptic isolators or compounding aseptic containment isolators waiver has been extended to 09/29/2020.  
• Order waiving restrictions on pharmacies, pharmacists and pharmacy technicians relating to ordering, collecting specimens for, and performing COVID-19 tests has been issued.

Ohio  
08/31/2020:  
The following emergency regulations have been re-issued:  
• Authorized the temporary expansion of the maximum days’ supply permitted under rule 4729-9-23 of the Administrative Code from 31 days to 60 days.  
• Authorized the sale and shipment of non-reportable dangerous drugs that are in shortage by unlicensed, out-of-state facilities.  
• Authorized the sale and shipment of patient-specific, non-reportable dangerous drugs by non-Ohio licensed border state facilities to patients residing in the state under certain conditions.

California  
08/27/2020:  
• Individuals who are enrolled in an approved postgraduate training program in CA and who would have been required to obtain a postgraduate training license by 6/30/2020, have been granted an extension until 10/31/2020 to obtain a postgraduate license.

• DCA Waiver DCA-20-53 defers the continuing medical education (CME) renewal requirement for licenses that expire between March 31, 2020 and October 31, 2020 for six months after the date of the waiver. Upon expiration of the six-month deferral period, the licensee must have completed the CME requirements.

Colorado  
08/30/2020:  
• The Board may issue a temporary license to an applicant that is a new graduate of an approved physician assistant program or anesthesiologist assistant program who meets all qualifications for licensure with the exception of successful completion of the required examination.  
• The Board may issue a temporary license to practice medicine to a foreign medical graduate applicant who has completed a minimum of 1-year of postgraduate training or practice in a foreign country and who meets all qualifications for licensure as set forth in section 12-240-110, C.R.S., with the exception of successful completion of the required approved internship or at least one year of postgraduate training approved by the board.

08/26/2020: The order allows a fully licensed PA to accept an emergency assignment to treat COVID-19 patients without having to maintain written supervisory arrangements.

08/30/2020: Temporary Licensure of Practical Nurses, Professional Nurses, Advanced Practice Nurses, and Certified Nurse Assistants and Temporary Suspension of Certain Nurse and Nurse Aide Education Requirements.
