Welcome to the Verisys Weekly Newsletter highlighting the COVID-19 regulatory updates between May 20 - 26, 2020.  

Verisys' Compliance Team gathers information from a variety of state and federal sources and updates our COVID-19 Resource Page daily with those updates. We have compiled the most recent updates from the past week in this email to assist your organization in serving patients during the pandemic and maintaining compliance as you bring additional providers on board to serve on the frontlines.

FEDERAL  
 
1135 waivers: Several states submitted an additional 1135 waiver request to CMS. The approved waivers have been published by the Centers for Medicare and Medicaid Services. Unless otherwise stated, all waivers are retroactively effective March 1, 2020.  
 
North Dakota (approved 5/22/2020)  
- Temporarily allow payment for 1905(a) personal care services rendered by legally responsible individuals.  
- Temporarily waive written consent required under home and community based service programs and permit documented verbal consent as an alternate.  
 
Texas (approved 5/14/2020)  
- Modification of the allowed timeframe for initial eligibility evaluations and assessments of home and community based services.  
- Modification of the deadline for initial and annual level of care determinations.  
- Allow managed care enrollees to proceed almost immediately to a state fair hearing without having a managed care plan resolve the appeal first by permitting the state to modify the timeline for managed care plans to resolve appeals to one day so the impacted appeals satisfy the exhaustion requirements.  
- Temporarily waive written consent required under home and community based service programs and permit documented verbal consent as an alternate.  
 
New Hampshire (approved 5/14/2020)  
- Postpone deadlines for revalidation of providers who are located in the state or otherwise directly impacted by the emergency.  
- Temporarily allow payment for 1905(a) personal care services rendered by family caregivers or legally responsible individuals.  
- Temporarily allow services to be provided in settings that have not been determined to meet the home and community-based settings criteria.  
 

STATE BOARD REGULATIONS
 
Board of Pharmacy  
 
Georgia  
05/20/2020: The Georgia State Board of Pharmacy has adopted an emergency rule temporarily waiving the practical examination from the licensing requirements. All applicants for pharmacist licensure must successfully pass the NAPLEX and jurisprudence examination (MPJE) administered by NABP. An individual is not eligible to take the examinations for licensure until such individual has graduated from an approved college or school of pharmacy, completed all internship requirements, and has a complete pharmacist application with no deficiencies pending with the Board. Once the Board receives an applicant’s passing NAPLEX and MPJE scores from NABP he/she will be issued a pharmacist license.  
 
Any applicant who has previously taken and failed the Georgia practical exam will not be eligible for licensure under this emergency rule. Source: GA Board of Pharmacy Practical Examination

West Virginia  
05/13/2020: 05/21/2020: The WV BOP has worked with WV DHHR Bureau for Public Health and the State Health Officer to provide Guidance with the appropriate contacts and pathways to follow for a pharmacist/pharmacy who decides to undertake the provision of COVID-19 testing at his/her pharmacy. Illinois  
05/13/2020: Revises Elective Surgeries Guidelines for Hospitals, Health Care Facilities, Health Care Professionals, and Health Care Volunteers Source: Executive Order 2020-37  
 
New Hampshire

05/26/2020: Suspend provisions requiring applicants to submit proof of completing examination requirements for physicians, physician assistants, dentists, dental hygienists, physical therapists, physical therapist assistants, audiologists, occupational therapists, occupational therapy assistants, and medical assistants. Oregon  
Unknown: The board of nursing has changed the previous license extension. All licenses that were active on March 24, 2020 qualify for a renewal deferral. Licensees have until 30 days after the end of the emergency declaration to renew. Previously providers were granted a 60 day extension from the license expiration date. West Virgina  
05/22/2020: The West Virginia Board of Medicine is partnering with the West Virginia Bureau for Public Health, the West Virginia Coronavirus Hotline and other state actors to ensure that West Virginia practitioners have access to updated information concerning Coronavirus Disease 2019 (COVID-19), including available testing criteria, information on setting up office PPE procedures and related questions.
